TERMS OF SERVICE FOR THE EFTI.EU WEBSITE

I. GENERAL PROVISIONS

  1. These Terms of Service define the rules for using the website available at https://www.efti.eu ("Website").

  2. The owner and operator of the Website is Trans Assist Sp. z o.o. with its registered office in Kielce, ul. Żniwna 21, 25-419 Kielce, entered in the Register of Entrepreneurs of the National Court Register maintained by the District Court Lublin-Wschód in Lublin with its seat in Lublin, VI Commercial Division of the National Court Register under KRS number 0000805737, NIP 9462691960, REGON 384448444 ("Service Provider").

  3. The Service Provider can be contacted at the e-mail address: [email protected] or by phone: +48 885 244 322.

  4. These Terms of Service constitute the terms of service referred to in Article 8 of the Act of July 18, 2002 on the provision of electronic services (consolidated text: Journal of Laws of 2020, item 344).

  5. Every person using the Website ("User") is obliged to read these Terms of Service before using the Website. Use of the Website constitutes acceptance of these Terms of Service.


II. TYPE AND SCOPE OF SERVICES PROVIDED ELECTRONICALLY

  1. Through the Website, the Service Provider provides the following services electronically:

    a. e-CMR Document Verification – a service enabling the User to verify the authenticity of e-CMR documents issued through the Trans Assist platform by completing a verification form containing the signature identifier (Signature ID) and the document issue date;

    b. Informational Content – a service providing Users with educational and informational materials regarding the implementation status of eFTI (Electronic Freight Transport Information) and eCMR (electronic CMR consignment note) regulations in individual countries, as well as news and analyses in the field of digitization of transport documents;

    c. Newsletter – a service consisting of sending commercial and educational information electronically regarding eFTI regulations, eCMR, transport digitization, and Trans Assist services to the e-mail address provided by the User.

  2. The services provided through the Website are free of charge.

  3. Use of the Website does not require account registration or logging in.


III. CONDITIONS FOR THE PROVISION OF ELECTRONIC SERVICES

  1. The following technical requirements must be met to use the Website:

    a. a device with Internet access (computer, tablet, smartphone),

    b. an up-to-date web browser (e.g., Google Chrome, Mozilla Firefox, Microsoft Edge, Safari) with JavaScript and cookies enabled,

    c. an active Internet connection,

    d. for the Newsletter service – an active e-mail address.

  2. The Service Provider makes every effort to ensure uninterrupted availability of the Website; however, it does not guarantee continuous operation. The Service Provider reserves the right to temporarily suspend the availability of the Website in whole or in part, in particular for maintenance, updates, or bug fixes.

  3. The Service Provider shall not be liable for technical problems resulting from the User's failure to meet the technical requirements specified in paragraph 1.


IV. RULES FOR USING THE E-CMR DOCUMENT VERIFICATION SERVICE

  1. The e-CMR document verification service enables the User to check whether an e-CMR document with the given signature identifier and date was issued through the Trans Assist platform.

  2. To perform verification, the User enters the following into the verification form:

    a. signature identifier (Signature ID),

    b. document issue date.

  3. The verification result is for informational purposes only and confirms solely whether an e-CMR document with the specified parameters was or was not issued in the Trans Assist system. The verification result does not constitute a legal opinion or an official document.

  4. Use of the verification service in an automated manner (e.g., through bots, scripts, mass querying programs) without the prior written consent of the Service Provider is prohibited.


V. INFORMATIONAL CONTENT

  1. Informational content published on the Website, including information on the implementation status of eFTI and eCMR regulations in individual countries, is of an exclusively educational and informational nature.

  2. Such content does not constitute legal, tax, customs, or other professional advice. The Service Provider recommends that Users consult with appropriate specialists to obtain binding information regarding the application of eFTI and eCMR regulations in specific situations.

  3. The Service Provider makes every effort to ensure that published content is reliable and up-to-date; however, it does not guarantee its completeness or timeliness. The implementation status of eFTI and eCMR regulations in individual countries may change, and the information on the Website may not reflect the most current legal status.

  4. The Service Provider shall not be liable for the consequences of decisions made by the User based on the informational content published on the Website.


VI. NEWSLETTER

  1. The User may voluntarily subscribe to the Newsletter service by providing their e-mail address.

  2. Subscribing to the Newsletter constitutes consent to receive commercial information electronically within the meaning of the Act of July 18, 2002 on the provision of electronic services.

  3. The User may unsubscribe from the Newsletter at any time by clicking the unsubscribe link included in each Newsletter message or by sending a relevant request to: [email protected].

  4. The Newsletter service is provided using the SendPulse Inc. platform. Details regarding the processing of personal data within the Newsletter are set out in the Website's Privacy Policy.


VII. INTELLECTUAL PROPERTY

  1. All content published on the Website, including texts, graphics, logos, icons, maps, infographics, page layout, and software, is the property of the Service Provider or entities from which the Service Provider has obtained appropriate licenses, and is protected under copyright law and industrial property law.

  2. Use of content published on the Website is permitted only within the scope of personal fair use. Copying, modifying, distributing, or using the Website's content for commercial purposes without the prior written consent of the Service Provider is prohibited.


VIII. COMPLAINTS

  1. The User has the right to submit a complaint regarding the functioning of the Website or the services provided through it.

  2. Complaints should be sent to the e-mail address: [email protected] or in writing to the Service Provider's registered office address.

  3. A complaint should contain at least:

    a. the User's contact details (e-mail address),

    b. a description of the problem constituting the basis for the complaint,

    c. the expected method of resolving the problem.

  4. The Service Provider will process the complaint within 14 days of its receipt and will inform the User of the outcome electronically to the provided e-mail address.


IX. FINAL PROVISIONS

  1. The Service Provider reserves the right to amend these Terms of Service. The Service Provider will inform Users of any changes through an appropriate notice on the Website. Changes shall take effect on the date indicated in the notice, which shall not be less than 7 days from the date of its publication.

  2. In matters not regulated by these Terms of Service, the provisions of Polish law shall apply, in particular the Civil Code, the Act on the provision of electronic services, and the Act on consumer rights.

  4. These Terms of Service are effective as of March 18, 2026.
